The 'Breeder' is Truebred Labradors, registered Breeder with Dogs NSW (formerly the Royal New South Wales Canine Council Ltd), Breeder registration 2000923580, contact details being PO Box 358 Taree NSW 2430, Ph: (02) 65514685 or 0432 665881.

The 'Puppy' is a purebred Labrador Retriever puppy that was born on 23 April 2008. And will be registered with Dogs NSW (formerly known as the Royal New South Wales Canine Council Ltd) by the Breeder.

1. The Client and the Breeder freely agree and consent to enter into this agreement.

2. The Client offers to purchase from the Breeder a purebred yellow Labrador Retriever Puppy, and the Breeder accepts the offer, in consideration and in accordance with the provisions of this agreement.

Ownership of the Puppy will be transferred to the Client for the sale price of $950.00, which is to be to be paid as follows:

a. a $250.00 deposit is to be paid by the Client to the Breeder within seven days of submitting this form;

b. the balance of $700.00 is to be paid to the Breeder at the time of either collection of the Puppy from the Breeder's premises, upon delivery of the Puppy to Heatherbrae, or prior to despatch of the puppy by the breeder for delivery to the Client.

4. If the Client requires the Puppy to be delivered elsewhere, the balance (including delivery costs, if any) are to be paid before the Puppy leaves the Breeder's premises.

The Breeder

5. The Breeder:

a. will provide a Puppy, and which has been:

  • vaccinated;
  • treated for intestinal worms;
  • microchipped;
  • examined by a Veterinarian; and
  • registered with Dogs NSW.

b. will also provide or arrange:

  • six weeks of free insurance (conditions apply);
  • vaccination certificate;
  • details of worm treatment;
  • details of microchipping;
  • registration and pedigree certificates; and
  • Labrador puppy care and welfare guide.

c. warrants that the parents of the Puppy are healthy at the time of completing this agreement;

d. warrants the Puppy to be healthy at the time of completing this agreement;

e. does not assume any liability for any injuries to the Puppy or others after delivery of the Puppy; and

f. warrants that the Puppy is a purebred and that the pedigree will be provided to the Client as soon as possible after delivery of the Puppy, and subsequently to the pedigree being received by the Breeder from Dogs NSW.

The Client

The Client:

a. agrees that the Puppy will live with the Client, be confined by a fenced yard (or otherwise adequately supervised or controlled), will have adequate exercise, nutritious food, and necessary health care, including scheduled vaccinations/worming;

b. agrees to exercise reasonable care and skill to assure the health and wellbeing of the pup at all times;

c. will ensure that Puppy will be provided with necessary veterinary care, upon sickness, disease, injury, or as otherwise advised by a qualified Veterinarian;

d. understands that the Breeder has limited information and control regarding the future temperament, habits, and appearance of the puppy, and hence can not and does not warrant such;

e. agrees that all costs relative to the shipping or delivery charges of the Puppy to the Client are to be assumed by the Client;

f. agrees to either collect the Puppy from the Breeder's premises or accept delivery of the Puppy, when the puppy is eight weeks of age or within seven days of that day;

g. relies upon their own skill and judgement to determine if the Puppy is suitable for the purposes for which it is being purchased; and

h. consents to microchip registration documents being submitted with personal details, addresses, etc of the Client included.

General

8. If the Puppy is collected from the Breeder's premises, there are no delivery costs;

9. If the Puppy is delivered to Heatherbrae (near Raymond Terrace, NSW), the delivery cost of $25.00 is payable by the Client to the Breeder at the time of delivery;

10. If the Puppy is to be delivered other than to Heatherbrae, the costs for such delivery are payable by the Client, and prior to the puppy being despatched.

11. The date and time for collection or delivery of the Puppy will be arranged by the Breeder, in consultation with the Client, and is to be within seven days of completing this form.

12. The Breeder neither makes or implies any warranties or guarantees, express or implied, other than those in this agreement including, without limitation, the warranties of merchantability and fitness.

13. As the normal purpose for which a Puppy is provided by the Breeder is as a pet, the Client relies upon their own skill and judgement to determine if the Puppy is suitable for the purposes for which it is being obtained. And also that this is a private sale, and is not for business, professional activity, trade, or profession.

14. All understandings between the parties are incorporated in this agreement. Its terms are intended by the parties as final and an exclusive expression of their agreement. If any provision of this agreement is held ineffective or invalid, the remaining provisions will nevertheless be given full force and effect.

15. No action or failure to act by any party hereto shall constitute a waiver of any right or duty afforded to such party under this agreement, nor shall any such action or failure to act constitute an approval of, or acquiescence in, any breach hereof except as may be specifically agreed in writing.

16. This agreement shall be governed by, and construed in accordance with, the laws of the State of New South Wales.

17. This agreement can be terminated by either party, by giving written notice to the other party, at least two days in advance of such termination. Where the agreement is terminated by the Client, the deposit is payable to the Breeder. And if already paid, may be retained by the Breeder and forfeited by the Client.

18. Where the agreement is terminated by the Breeder, all amounts received from the Client will be refunded to the Client.

19. Where the collection, delivery, or acceptance of the Puppy does not occur when the puppy is eight weeks of age, or within seven days of that date, then the Breeder can retain any amounts already received from or payable by the Client. And this does not limit the rights of the Breeder in any regard.

20. There are no legal impediments that prevent either party from entering into this agreement. And both parties acknowledge that they have the legal capacity to do so.

21. Ownership, title, etc of the Puppy does not transfer to the Client until the Breeder has received full payment, including delivery costs (if any).

22. The deposit can be paid by personal cheque, bank cheque, money order, or credit card. The balance can be paid by cash, bank cheque, money order, or credit card. Payments made by credit card are to be finalised by no later than two days prior to despatch.

23. If the deposit is not paid within seven days of submitting this form, this Agreement shall be terminated and the Client forfeits any paymenys given hereunder.

24. Details for paying by direct deposit to our bank account or by paying by credit card will be sent to you by email (if applicable). Payment by mail can be sent to Truebred Labradors, PO Box 358 Taree NSW 2430. Cheques and money order should be made payable to 'B. Daniel'.
